On September 20, 2022, the General Administration of Customs issued Order No. 259, 'The People's Republic of China Customs Import and Export Commodity Inspection and Acceptance Management Measures' (hereinafter referred to as the 'Measures'), which came into effect on December 1 of the same year.The 'Measures' are specific measures taken by the Customs to implement the State Council's deepening of the reform deployment of 'decentralization, control and service' and to optimize the inspection of import and export commodities.According to the 'Measures', for import and export commodities that are subject to customs approval, enterprises can choose whether to entrust inspection agencies to conduct inspections according to their needs; the customs shall adopt the inspection results in accordance with the law as the basis for conformity assessment, and are exempted from implementing sampling inspections.The implementation of accreditation and the introduction of social inspection and testing resources to optimize the inspection of import and export commodities will help stimulate the vitality of market players, improve the convenience of customs clearance, and better serve the overall situation of diplomacy and foreign trade.

Letter-Adopting Institutions

What is an Accreditation Agency?

Answer: According to the second paragraph of Article 4 of the 'Measures', the acceptance institution refers to the inspection institution that has the qualifications and capabilities required by the customs and is listed in the catalog of acceptance institutions by the General Administration of Customs.The acceptance agencies carry out inspection and testing activities in accordance with the relevant requirements of the General Administration of Customs, and the inspection and testing results can be accepted by the customs as the basis for conformity assessment.

What are the requirements for an inspection and testing institution applying to be listed as an accreditation institution?

Answer: According to Article 7 of the 'Measures', inspection and testing institutions that meet the following conditions can apply to the General Administration of Customs to be included in the catalog of accreditation institutions:

——has the legal business qualification in the country or region where it is located;

- Possess the ability to inspect relevant commodities;

——Inspection institutions registered in the territory of the People's Republic of China: obtain the corresponding domestic qualification accreditation such as the accreditation of inspection and testing institutions (CMA), or obtain the accreditation of ISO/IEC 17025 and ISO/IEC 17020 implemented by the China National Accreditation Service for Conformity Assessment (CNAS);

——Inspection institutions registered outside the People's Republic of China: obtained the ISO/IEC 17025 and ISO/IEC 17020 system accreditation implemented by the accreditation body of the International Laboratory Accreditation Cooperation Organization Mutual Recognition Agreement (ILAC-MRA);

——Familiar with and abide by the relevant laws, regulations and standards of the People's Republic of China on commodity inspection;

——Having the ability to carry out inspection activities independently, impartially and objectively;

——There is no illegal record related to inspection at home and abroad in the past three years.

If otherwise stipulated by the General Administration of Customs, such regulations shall prevail.

What materials do inspection and testing institutions need to submit to apply for inclusion in accreditation institutions?How to submit?

Answer: According to Article 8 of the 'Measures', an inspection institution applying for inclusion in the catalog of accreditation institutions shall submit the following materials to the General Administration of Customs through the accreditation management system (China International Trade Single Window):

(1) Application form;

(2) Legal person information and investor information of the inspection institution;

(3) Relevant qualification accreditation or accreditation certificates and relevant supporting materials;

(4) A statement on the scope of technical capabilities, including the inspection scope of relevant qualifications, inspection methods and inspection standards adopted;

(5) Statement of independence for engaging in inspection activities and relevant certification materials;

(6) A statement that there is no illegal record related to inspection at home and abroad in the past three years;

(7) The list of issuers of the commodity inspection report.

If the relevant materials are in a foreign language, a Chinese translation shall be attached.

The General Administration of Customs evaluates and examines the inspection institutions that apply to be included in the catalog of accreditation agencies, and those that meet the requirements are listed in the catalog of accreditation agencies.





PART.03

Enterprise

The enterprise is the 'People's Republic of China Customs Import and Export Commodity Inspection and Acceptance Management Measures''The main audience, how can import and export enterprises enjoy the dividends of commodity inspection and acceptance?Please follow the steps below.


Step 1: Check the range of accepted commodities.If the commodities imported and exported by your company are within the scope of accreditation, you can choose to implement the accreditation of inspection results.


Step 2: Find a credit agency.Look up the catalog of accreditation agencies corresponding to the commodities imported and exported by your company, and find a suitable accreditation agency.


Step 3: Entrust a letter-acquisition agency to inspect the goods, and submit an inspection report to the customs through the letter-acquisition management system.The submission time should be before the declaration of import and export goods (unless otherwise stipulated in the acceptance requirements).If it is not submitted within the specified time limit, the customs will not accept it.

In addition to meeting the content requirements of the inspection and testing qualification regulations, the inspection report issued by the accreditation agency shall also include the following contents:

(1) The name and code of the admissibility agency;

(2) Inspection report number;

(3) Product information, including product name, model specification, corresponding batch number or product serial number, and other product traceability information;

(4) The inspection items, inspection methods, and sampling plans specified in the acceptance requirements;

(5) The name and contact information of the client;

(6) Date of acceptance, place of inspection, time of inspection and date of issuance;

(7) Inspection results;

(8) Signature of the issuer.


Step 4: The consignee or consignor of the imported or exported goods or its agent shall provide the inspection report number and the code of the acceptance agency that issued the inspection report to the customs in accordance with the regulations, and the customs shall review the corresponding inspection report according to the acceptance requirements.If the requirements are met, the inspection results shall be accepted; if the requirements are not met, the inspection results shall not be accepted.


Step 5: If the customs accepts the inspection results, the consignee or consignor of the imported or exported goods or its agent shall submit a statement of quality and safety compliance to the customs, and the customs will no longer sample the imported and exported goods, but the customs will carry out inspections according to the needs of risk prevention and control exception.


The implementation of accreditation of inspection results will bring greater discounts and convenience to commodities with large import and export quantities, frequent batches, and high sampling ratio.First, the customs no longer conduct sampling inspections, and import and export goods can be quickly inspected and released, which is conducive to speeding up the time limit for customs clearance; second, the inspection results are used throughout the country and can be reused within the validity period, which is conducive to reducing costs for enterprises.Taking a certain product as an example, if the annual import and export volume is 1,000 batches, the sampling rate is 2%, and 3 pieces are sent for inspection each time, at least 20 batches and 60 pieces must be sent for inspection.After the inspection results are accepted, within the validity period of the inspection report, at least one inspection is required, and the quantity is 3.
