Ministry of Commerce Announcement No. 22 [2022] Announcement on the Ruling on the Final Review of Anti-dumping Measures for Imported Grain-oriented Electrical Steel Originating in Japan, South Korea and the European Union
On July 23, 2016, the Ministry of Commerce issued Announcement No. 33 of 2016, deciding to impose anti-dumping duties on imports of grain-oriented electrical steel originating in Japan, South Korea and the European Union from July 23, 2016, and the implementation period is five years.The corporate tax rates are: 39.0%-45.7% for Japanese companies; 37.3% for Korean companies and 46.3% for EU companies.On June 5, 2018, the Ministry of Commerce issued the Announcement No. 11 of the year, deciding to accept the application for price commitment from POSCO Co., Ltd. and to implement the price commitment from June 9, 2018.From the date of implementation, the collection of anti-dumping duties on grain-oriented electrical steel products of POSCO Co., Ltd. will be suspended.
On January 29, 2021, the Ministry of Commerce issued Announcement No. 3 of 2021.According to the announcement, after the end of the Brexit transition period on December 31, 2020, the trade remedy measures previously implemented against the EU will continue to apply to the EU and the UK, and the implementation period will remain unchanged; trade remedy investigations newly initiated by the EU after this date and review cases, and no longer treat the UK as an EU member state.
On July 23, 2021, in response to the application of China's grain-oriented electrical steel industry, the Ministry of Commerce issued Announcement No. 16 of 2021, deciding that from July 23, 2021, import grain-oriented electrical steel institutes originating in Japan, South Korea and the European Union will be banned. Applicable anti-dumping measures are subject to expiry review investigation.Considering the actual situation of UK grain-oriented electrical steel, the applicant did not file an application for expiry review investigation of anti-dumping measures against the UK.From July 23, 2021, the anti-dumping measures applicable to imports of grain-oriented electrical steel originating in the UK will be terminated.The Ministry of Commerce has investigated the possibility of continuation or reoccurrence of dumping of imported grain-oriented electrical steel originating in Japan, South Korea and the European Union, and the possibility of continuation or recurrence of damage to China's grain-oriented electrical steel industry if the anti-dumping measures are terminated , and in accordance with Article 48 of the 'Anti-dumping Regulations of the People's Republic of China' (hereinafter referred to as the 'Anti-dumping Regulations'), make a review ruling (see Annex).The relevant matters are hereby announced as follows:
The Ministry of Commerce ruled that if the anti-dumping measures are terminated, the dumping of imported grain-oriented electrical steel originating in Japan, South Korea and the EU to China may continue or occur again, and the damage to China's grain-oriented electrical steel industry may continue or occur again.
According to the provisions of Article 50 of the Anti-dumping Regulations, the Ministry of Commerce proposed to the Customs Tariff Commission of the State Council to continue levying anti-dumping duties according to the investigation results.From July 23, 2022, anti-dumping duties will continue to be levied on imports of grain-oriented electrical steel originating in Japan, South Korea and the European Union for a period of five years.
The product range for which anti-dumping duties are levied is the product to which the original anti-dumping measures apply, which is consistent with the product range in Announcement No. 33 of 2016 of the Ministry of Commerce.details as follows:

This product is included in the 'Import and Export Tariff of the People's Republic of China (2022)':72251100, 72261100。
The rate of continued collection of anti-dumping duties is the same as that stipulated in Announcement No. 33 of 2016 of the Ministry of Commerce.
During the investigation, Nippon Steel Co., Ltd. submitted an application to the investigation authority, saying that Nippon Steel & Sumitomo Metal Co., Ltd. had changed its name to Nippon Steel Co., Ltd. on April 1, 2019, and requested the investigation authority to use the change in this final review ruling. The new company name replaces the original company name.After review, the investigation authority decided to accept the company's application for renaming, and agreed that NIPPON STEEL CORPORATION would inherit the 45.7% anti-dumping measure applied by Nippon Steel & Sumitomo Metal Corporation in the original anti-dumping measures. tax rates and other rights and obligations.Grain-oriented electrical steel products exported to China under the name of Nippon Steel & Sumitomo Metal Corporation shall be subject to the 45.7% anti-dumping duty rate applicable to 'other Japanese companies' in the original anti-dumping measures.

1. The anti-dumping tax rate of POSCO Co., Ltd. (POSCO) is 37.3%.The Ministry of Commerce has decided to continue to implement the price commitment for the products under investigation imported by POSCO Co., Ltd. from July 23, 2022 in accordance with the Ministry of Commerce Announcement No. 11 of 2018. Unless terminated in advance, the price commitment is valid until the date of the termination of this anti-dumping measure.During the implementation of the price commitment, the grain-oriented electrical steel imported from POSCO Co., Ltd. is not subject to anti-dumping duties.If there is a violation of price commitments or other termination price commitments, anti-dumping duties will be levied on them at the above rates.

From July 23, 2022, import operators shall pay corresponding anti-dumping duties to the Customs of the People's Republic of China when importing grain-oriented electrical steel originating in Japan, South Korea and the European Union.Anti-dumping duties are levied ad valorem based on the dutiable value verified by the customs. The calculation formula is: anti-dumping duty amount = customs dutiable value × anti-dumping duty rate.The import value-added tax is levied on the ad valorem basis of the dutiable value verified by the customs plus customs duties and anti-dumping duties.
According to the provisions of Article 53 of the Anti-dumping Regulations of the People's Republic of China, those who are not satisfied with this review decision may apply for administrative review according to law, or they may file a lawsuit in a people's court according to law.
This announcement will be implemented from July 23, 2022.
